NEW DELHI: The National Capital Region (NCR) states on Friday requested the Supreme Court to allow the bursting of green firecrackers in Delhi and surrounding areas during Diwali .
Solicitor general Tushar Mehta, representing the NCR states , told a bench of Chief Justice B R Gavai and Justice K Vinod Chandran that green firecrackers could be permitted between 8 pm and 10 pm on Diwali.
"We have made suggestions," Mehta told the bench, adding that the states had proposed a balanced approach for the court to consider.
He said the use of firecrackers could be allowed in the NCR under certain conditions, including that only green crackers approved by the National Environmental Engineering Research Institute (NEERI) be manufactured and sold.
Mehta said the NCR states, the Delhi government, and the Petroleum and Explosives Safety Organisation (PESO) would ensure that joint firecrackers, or ‘laris’, are not produced, sold, or used.
"Let the children celebrate at least for two days," Mehta said, as quoted by Live Law.
He suggested that sales should take place only through licensed traders, who would be required to sell only permitted crackers.
"It shall be ensured by the NCR state governments, GNCTD and PESO that no e-commerce website, including Flipkart, Amazon etc, shall accept any online order and effect any online sale," Mehta said.
He further proposed that on Christmas Eve and New Year’s Eve, crackers should be allowed from 11.55pm to 12.30am.
For Gurpurab, Mehta suggested that crackers could be used from 4 am to 5 am and again from 9 pm to 10 pm. He added that the sale and use of green crackers could also be permitted for marriages and other occasions.
The hearing on the matter is still in progress. The Supreme Court is examining issues related to the manufacture and sale of green firecrackers in Delhi-NCR.
On September 26, the court allowed certified manufacturers to produce green firecrackers, but said they cannot be sold in Delhi-NCR without its approval. It also asked the Centre to reconsider the total ban on firecracker manufacturing in the region.
Delhi and 16 districts from Uttar Pradesh, Rajasthan, and Haryana together make up the NCR.
